ALLPAY CARD PAYMENTS - TERMS AND CONDITIONS

1 Application of Terms

1.1 This page sets out the terms and conditions under which you can make payments through the allpay internet payment facility (“Facility”) on our website or via the allpay mobile application (“App”). Please read these terms carefully before using the Facility or App.

1.2 By clicking the “I accept” button to confirm your agreement to these terms and conditions. If you do not do so you will not be able to use the Facility or App.

1.3 You may make payments to any or your accounts which are registered with us by text from your mobile phone or via our automated telephone payment system from your mobile phone or landline, and these terms and conditions also apply to those payments.

1.4 We reserve the right to make changes these terms and conditions from time to time and you should check this page each time you use the Facility or App, or make a payment from your mobile phone or landline.

2 Information about us

2.1 We are allpay Ltd of Fortis et Fides, Whitestone Business Park, Whitestone, Hereford HR1 3SE; company number 02933191. Our VAT number 666 9148 88.

2.2 We are fully compliant with the Payment Card Industry Data Security Standard (PCI DSS).

3 Use of our payment facility

3.1 You can use the Facility or App to make payments to any of your accounts which are registered with us.

3.2 Online payments can be made by debit or credit card. Your payments are not collected by us directly, but by the bank on behalf of the applicable authority or service provider.

3.3 We do not make any administration charge for using the Facility or App to make any payment.

4 Making payments

4.1 You must use your unique payment reference number (“PRN”) when making a payment. Please take care that the information you enter is correct. You can cancel any payment at any time up until you press the “Confirm” button.

4.2 You must keep all PRN numbers and your online username and password secret.

4.3 You must not use any debit or credit card to make a payment through the Facility or App unless you are the cardholder or you have authority from the cardholder to do so. If we suspect that you are using any payment card fraudulently we reserve the right to pass your information on to the applicable law enforcement agency without notice to you.

4.4 Payments will be processed by the end of the day after you use our Facility or App to make a payment.

5 Confirmation of payment

5.1 Once your payment has been authorised, a confirmation screen will be displayed showing the payment details and a transaction reference number. These details will also be e-mailed to you.

5.2 Please keep a note of the transaction reference number, as you will need to quote this if you have any queries with your payment.

5.3 Please note for the purposes of the Payment Services Directive, point of payment of any bill is deemed to have taken place as soon as the transaction has been received.

6 Refunds

6.1 If you make a mistake in any payment, you should contact our customer services team immediately. You will need to have the payment reference number, PRN number and payment card details to hand.

6.2 Refunds may be made in exceptional circumstances in our discretion.

6.3 If you request a chargeback from your card issuer, or if the bank or your payment card provider confirms that an unauthorised payment has been made using your card, allpay will take steps to process the chargeback or refund the unauthorised payment.

6.4 All refunds will be made to the payment card which you used to make the payment. We aim to process refunds within 30 days.

7 allpay Cashless

7.1 You may use the Facility or App to make payments to the allpay Cashless, in which case the following additional terms apply.

7.2 You are responsible for monitoring the balance of your allpay Cashless account and for keeping your account in sufficient credit to cover your child’s or your own purchases. We do not monitor the balance of your allpay Cashless account and are not obliged to tell you if the balance of your account is low, zero or has a negative balance.

7.3 If your account does not have sufficient credit to cover any purchase which you or your child may make, the school or service provider may choose in their sole discretion to allow the purchase. However, we are not liable to you or your child if the school or service provider does not allow the purchase.

8 TEXT AND IVR PAYMENTS

8.1 If you register with us to make payments by text, we will store your payment card details in order for us to be able to process your payments. We will keep your payment card details safe as described in condition 9.2 of these terms and conditions.

8.2 We will confirm each text payment by sending a confirmation text to your mobile phone.

8.3 Where you make a payment via our automated telephone payment system, you must have your PRN number and payment card details to hand. We will confirm your payment at the end of the call by providing you with an authorisation code for your payment. Please ensure that you write the authorisation code down in case you need to contact us about your payment.

9 Security

9.1 We may store yourpayment card details solely for the operation of the Facility or App. Other than as necessary to process your payment, we will not share your payment card details with any third party or make them visible or accessible outside the secure banking network.

9.2 We will always take care to ensure your payment card details are kept safe and secure, in accordance with the PCI DSS. Your card details will be stored on a server behind a secure firewall, and only a limited number of authorised employees will be able to access this information .

10 Disclaimer of Liability

10.1 In no event will we be liable for any damages whatsoever arising out of your use, inability to use, or the results of use of this Facility or the App, this website or any websites linked to it, or the materials or information contained at any or all such websites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

10.2 We do not accept liability for a payment not reaching the correct account due to you quoting an incorrect PRN or account number or incorrect personal or card details.

10.3 If your payment card provider declines any payment, your account will not be credited and we are under no obligation to bring this fact to your attention. We do not accept liability if any payment is refused or declined by your payment card provider for any reason. You should check with your bank or payment card provider that payment has been deducted from your account. If your payment is refused you will need to contact your payment card provider to discuss the reasons for the refusal and make alternative arrangements to make payment to the account.

12 Governing Law

12.1 These Terms and Conditions are governed by and to be construed in accordance with English Law. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

13 Marketing

13.1 We may also use your personal data, or allow certain third parties to use your personal data, to provide you with information about products and services which may be of interest to you. We or they may contact you about these by post, telephone, email or SMS.

13.2 Please see “Your Rights” (below) if you wish to unsubscribe.

14 Disclosure of your personal data to third parties

14.1 We may share your personal data with any of our subsidiaries or our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

14.2 We may share your personal data with third parties to the extent necessary to process your payment. We may also disclose your personal data to third parties:

14.2.1 if we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer, and if we sell any business or assets your personal data will be one of the transferred assets;

14.2.2 if we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation, or in order to enforce any of our terms of business or other agreements; or to protect the rights, property, or safety of allpay Ltd, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

15 Your rights

15.1 You may ask us at any time not to use your personal data or allow a third party to use it for marketing purposes. You can prevent us from doing this by ticking certain boxes on the forms which we use to collect your data. You can also ask us at any time to stop sending marketing information to you by contacting us at the email address support@allpay.net .

15.2 You may request details about the information hold about you by writing to The Data Protection Officer at the address dataprotection@allpay.net We may charge you a fee of £10 to cover our costs in meeting your request.
